Alcatel Republic of Ireland Operation - Europe Flight Conditions For Customers

  1. Organising company
    • 1.1 The company TLC Marketing France, a limited liability company, registered at the Trade and Companies Register of Paris under number 491 414 306 whose registered office is located at 92 avenue de Wagram 75017 Paris, is organizing from 01/07/2016 to 12/08/2016, in the Republic of Ireland, a promotion called “Alcatel Republic of Ireland Promotion” (hereinafter “the Promotion”) in partnership with TCT Mobile Europe SAS, which markets “ALCATEL” branded products associated with the Promotion.
    • 1.2 Conditions for participation in the Promotion are defined below
  2. Description of the promotion
    • 2.1 Any person who bought an Alcatel POP 4, POP 4+ or POP 4S telephone between 01/07/2016 and 12/08/2016 can participate in the Promotion under the terms and conditions set out in Article 3 below (hereinafter the “Participant”), in order to receive a code to access a booking form for a return flight offered for one person to a European destination.
    • 2.2. The return flight (excluding airport taxes, excluding fuel costs) is offered in economy class, with a regular or low-cost company, to one of the following European destinations: Amsterdam, Barcelona, Berlin, Brussels, Lisbon, London, Paris, Rome or Stockholm. The departures may be from Dublin or Cork. A different person to the person who bought the telephone may take the flight. As appropriate, it is stated that the person who wants to take the flight will necessarily be the person filling out the Promotion participation form under the conditions described below.
    • 2.3 Costs remaining borne by the Participant:
      1. 2.3.1 Airport taxes, extra fuel costs, insurance costs and any extras are to be borne by the Participant.
      2. 2.3.2 Furthermore, some airlines do not include baggage in the price of the ticket. The customer service department of the Organising Company will then specify this to the Participant when sending the flight proposal. If the Participant wishes to add one or more bags to his ticket, he must specify this when his flight proposal is confirmed in writing. The customer service department of the Organising Company will then advise of the related cost. Following the validation of the new amount, it will be added to the airport taxes and charged to the participant. Additional baggage remains the sole responsibility of the Participant (additional information about the validation of the flight proposal and the payment of airport taxes and any other costs are available in Article 4.5.3)
      3. 2.3.3 The Participants will also be responsible for their travel to the airport of departure. Travel insurance is also not included.
      4. 2.4 Lastly, it is specified that some flights require a stopover. The airport of departure and the destination chosen will determine the regular or low-cost airline selected.
  3. Terms and conditions of the promotion
    • 3.1 Participation in the Promotion is personal and limited to two entries per household (same name, same address) or maximum entity, and is open to people aged 18 years and over, residing in the Republic of Ireland, who bought an Alcatel POP 4, POP 4+ or POP 4S telephone between 01/07/2016 and 12/08/2016 in one of the Republic of Ireland stores or on one of the merchant websites in the Republic of Ireland participating in the Promotion. Participation in the Promotion is subject to conditions and may not be combined with other promotions, offers or benefits.
    • 3.2 The employees of TLC Marketing, TCT Mobile Europe or their agents and distributors as well as their family members may not participate in the Promotion.
  4. Terms of participation
    • 4.1 Validation of Participation in the Operation
    • 4.1.1 To participate in the Promotion, the Participant must visit http://POP4promo.alcatel-mobile.com and duly complete the entry form available on the website within 30 calendar days following the end of the Cooling Off period (14 calendar days following the date of purchase), Republic of Ireland connection time being applicable, connection fee not reimbursed, by following the steps below:
      • Click on the “I Participate” page and complete the online entry form with:
      • The Participant’s full contact information (first and last name, postal address, email address and landline number)
      • A scan or photo of the Participant’s invoice, with the reference of the product eligible for the offer and the date of purchase, to be uploaded,
      • A scan or photo of the Participant’s valid passport or identity card, to be uploaded.
    • The Participant confirms his participation by clicking the button “I want to participate in the Operation.” By validating my participation, I accept the Terms and Conditions of Participation in the Promotion.”

    • Online entry forms that are incomplete, incorrectly completed, validated late or not meeting the conditions of the Promotion will be void and will not be processed. In this case, an email will be sent by the Organising Company to the Participant of the offer to indicate to him the reasons for invalidation within a period of approximately two (2) weeks. No further action will be taken on invalidated forms.
    • 4.1.2 A confirmation page will attest to the Participant that his participation has been registered, and at the same time he will also receive a confirmation email. This email will be sent to the email address listed by the Participant in the online entry form
    • 4.2 Sending of a reservation code by the Organising Company
    • As of the Participant’s registration of his online entry form and if it is valid, the Organising Company will send by email within a maximum of two (2) weeks, a personal booking code enabling the Participant to access an online booking form for his flight online.
    • The booking code giving access to the online booking form has no cash value, is not transferable and cannot be sold, resold or refunded. No compensation of any kind or equivalent value in cash is possible.
    • The Organising Company, its agents or distributors will not replace any reservation code giving access to the online booking form that has been lost or deleted.

    • 4.3 Flight preferences of the Participant
      1. 4.3.1 Upon receipt of the email containing his personal booking code, the Participant has a period of thirty (30) calendar days to confirm the online flight booking Republic of Ireland connection time being applicable, connection fee not reimbursed). No booking form validated beyond thirty (30) calendar days will be accepted.
      2. The Participant must indicate on the flight booking form the preferred departure airport (from the departure airports available), and flight preferences by choosing three (3) different destinations, three (3) different departure dates and three (3) different return dates.
      3. 4.3.2 The Participant must choose departure dates at the earliest after sixty (60) calendar days from the date the completed booking form is sent to the Organising Company. Depending on availability of flights, the maximum duration of the requested stay is one (1) month. The booking must also include a Saturday night at the destination.
      4. Travel must take place before 30/06/2017. If the conditions mentioned above are not fulfilled, the Participant’s booking form will be considered invalid and he will not be entitled to a second chance. No further action will be taken on these forms and an invalidation email will be sent to him.
      5. 4.3.3. Moreover, the person whose details are recorded on the flight booking form must be the same person who validated his participation in the Promotion. The Organising Company will refuse any booking form that is submitted by someone other than the Participant who validated the Entry Form.
      6. In the event that (i) two (2) Participants, who each received a code to access a booking form, would like to travel on the same flight, each must complete his booking form and indicate in the space provided for this purpose the booking code of the other Participant so that the Customer Service Department of the Organising Company can process this joint request.
      7. It is recalled that only one booking form is used per person or per booking group.
      8. In addition, the Organising Company will make every effort to access the joint request of the Participants. However, it cannot guarantee to two participants who each completed a booking form and indicated the booking code of the other Participant that they will have the opportunity to travel on the same flight.
      9. 4.3.4 Online booking forms that are incomplete, incorrectly completed, validated late or not meeting the conditions of the Operation will be void and will not be processed. An email will in that case be sent by the Organising Company to the Participant to indicate to him the reasons for invalidation within six (6) to eight (8) weeks. No further action will be taken on invalidated forms.
    • 4.4 Proposal of flights by the Organising Company
    • Upon receipt by the Organising Company of the completed and validated flight booking form, it will contact the Participant, within six (6) to eight (8) weeks maximum to confirm the availability of his choices and tell him the destination, departure date and return date selected among his possible choices indicated on the online booking form for each of these items, namely: destination, departure date and return date, as well as the amount of airport taxes and other charges remaining still owed by him.
    • Everything will be done to try to obtain the first choice of the Participants. However, the dates and destinations are subject to promotional availability made available by the partner companies (promotional availability) and cannot be guaranteed: in particular, this concerns high season periods, the months of July, August, December Christmas holidays and school holidays in the departure and arrival destinations.
    • 4.5 Validation of the Flight Proposal by the Participant

      1. 4.5.1 The Participant must respond to the proposal made by the Organising Company within a maximum period of forty-eight (48) hours of receipt of the proposal made. Each proposal is based on real time availability, therefore the Organising Company cannot be held responsible for any change in availability between the time of making the proposal and the Participant responding.
      2. If there is no response within that time, the Participant will lose all entitlement to this offer and will not be entitled to any other proposal, or any damages, equivalent value in cash, or compensation of any kind from the Organising Company or its partners. TLC Marketing will have fulfilled all of its obligations to the consumer.
      3. 4.5.2 Similarly, if the three (3) of the options chosen by the Participant are unavailable, the Organising Company will contact him to propose an alternative flight (with change of the departure and return date and the possible departure and/or arrival destination). The participant must then respond to the proposal made by the Organising Company within a maximum period of forty-eight (48) hours. However, if the Participant does not respond within the required time, or does not accept this alternative proposed by the Organising Company, the Participant will lose all entitlement to the benefits of the Operation and shall not be entitled to any other proposal from the Organising Company or any other damages or compensation to this effect. TLC Marketing will have fulfilled all of its obligations to the consumer.
      4. 4.5.3 The airport taxes, any additional fuel cost, any extras (insurance and / or luggage) and, where applicable, other specific costs related to partner companies remain the responsibility of the Participant and are payable to the Organising Company by the Participant upon confirmation of the booking. These charges cannot be refunded after booking.
      5. Once the participant has received the flight proposal and wishes to accept it, the Participant will pay these fees by telephone, by PayPal. The Organising Company will send the Participant a PayPal link with an invoice for immediate payment. The Participant will be required to share the PayPal confirmation with the TLC booking team before the booking can be confirmed. We are unable to hold any flight availability.
    • 4.6 Flight confirmation by the Organising Company
      1. 4.6.1 After receiving validation by the Participant of the flight proposal under the conditions defined above, and payment of the costs remaining payable by him, the Participant will receive by e-mail or otherwise by mail, the electronic ticket corresponding to the confirmed booking.
      2. On the day of departure, he must present this electronic ticket when boarding along with the valid documents required to board the flight corresponding to the confirmed booking.
      3. 4.6.2. It is the responsibility of the Participant to ensure that he has a passport, visa or any other document required and valid to board the flight. This also applies to anyone accompanying him.
      4. 4.6.3 The flight times shown on the Participant’s itinerary or at other locations are subject to being changed by the airline between the flight confirmation date and the travel date. The Participant must confirm the actual time of the flight by contacting the airline directly prior to his travel date.
      5. The cost of the travel to and from the airport and all other costs and expenses incurred including, but not limited to, accommodation, meals and drinks are excluded from the promotion.
      6. The Organising Company, its agents and distributors cannot be held responsible for the accuracy of the information provided by partner airlines, nor can they be held responsible for any change of itinerary, route or destination, or any delay or flight cancellation: for any claim the beneficiary should contact the airline.
    • 4.7.3 In case of cancellation by the Participant, he will notify the booking team of the Organising Company by calling 01 513 3747 (local call - variable rate depending on the operator – available from Monday to Friday from 9:30 a.m. to 5:30 p.m. excluding holidays) or by sending an email to alcatel-ireland@tlcrewards.com (with the subject: Alcatel Republic of Ireland Operation / his first and last name). No cancellations or changes are possible after confirmation of the booking by the Organising Company.
    • If cancelled, the Participant will lose all right to benefit from the Operation and may not claim any proposal from the Organising Company, or any other damages or compensation to this effect.
  5. Limitations of liability
    • Neither the Organising Company nor its agents or distributors may be held responsible for the management, quality or services of the airlines and will handle any complaint, claim, or dispute of any kind relating to flights. The Participant must contact the airline directly for any complaint, claim or dispute.
    • The Organising Company reserves the right to cancel or modify the reservation without notice due to the occurrence of a force majeure event without the Participant being entitled to additional compensation, damages of any kind, or equivalent value in cash.
    • If there is a force majeure event, the Organising Company reserves the right to cancel or replace this offer with another offer of equivalent or greater value, without the beneficiary of the offer being entitled to additional compensation, damages of any kind, or equivalent value in cash.
    • The offer and booking forms are personal and consequently the airlines and TLC Marketing will refuse any booking form or airline ticket presented by a person other than the beneficiary of the offer (natural person who participated in the offer).
  6. General provisions
    • All information in this document constitutes the Terms and Conditions of Participation in the Promotion. Participation in the Promotion implies prior unconditional acceptance of these Conditions. The Organising Company reserves the right to modify these Conditions without notice.
    • The Promoter and its Agent reserve the right to offer a substitute offer of equal or greater value and to withdraw the promotion at any time deemed necessary owing to circumstances outside their reasonable control.
    • The Agent administering this promotion is TLC Marketing UK Ltd., PO Box 468, Swansea SA1 1RH.
    • Any written queries should be sent to the Agent at the above address titled ‘ Alcatel Flight Promotion’.
    • Any question concerning the legal interpretation of the rules will be based on Irish law and the Courts of Republic of Ireland will have exclusive jurisdiction.
    • The offer is available in partnership with TCT MOBILE EUROPE SAS - 55 avenue des Champs Pierreux, 92000 Nanterre, registered in the Trade and Companies Register of Nanterre under number B 440 038 222, in charge of marketing the “ALCATEL” branded telephones associated with the Promotion.
